These Terms & Conditions (“Terms“) govern your access to and use of the website located at https://www.opbproperties.com/ and any related pages that link to these Terms (collectively, the “Site“). The Site is operated by OPB Holdings (“OPB Holdings,” “we,” “us,” or “our“). By accessing or using the Site, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By visiting or using the Site, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree, do not use the Site.

2. OUR SERVICES

OPB Holdings connects homeowners with a service to quickly receive a cash offer for their properties by submitting basic information through the Site (the “Services“). Submitting information through the Site does not obligate you to sell or obligate us to make an offer. Any cash offer is subject to verification, inspection, title review, and other customary due diligence.

3. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the Site, you acknowledge that you have read and understand our Privacy Policy.

4. USER OBLIGATIONS

  • Accurate Information. You agree to provide true, accurate, and complete information when interacting with the Site or Services and to keep it up to date.
  • Prohibited Conduct. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OPB HOLDINGS OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless OPB Holdings and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site or Services; (b) your User Content; or (c) your violation of these Terms or applicable law.

12. GOVERNING LAW; VENUE

These Terms and any dispute arising out of or in connection with them are governed by the laws of the State of New York, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York.

13. ARBITRATION & CLASS ACTION WAIVER (OPTIONAL)

At our sole discretion, any dispute may be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules. To the fullest extent permitted by law, you agree to waive participation in any class action. If you do not agree to arbitration, you may opt out by sending written notice to info@opbproperties.com within 30 days of first use of the Site.

14. CHANGES TO THE SITE OR TERMS

We may update the Site and these Terms from time to time. The “Last updated” date above indicates when these Terms were last revised. Your continued use of the Site following any changes constitutes acceptance of those changes.

15. TERMINATION

We may suspend or terminate your access to the Site, with or without notice, for any reason, including if we believe you have violated these Terms or applicable law.

16. MISCELLANEOUS

  • Entire Agreement. These Terms constitute the entire agreement between you and OPB Holdings regarding the Site and Services.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver. Our failure to enforce any right or provision is not a waiver of such right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
